Captain Morgan is being sued for piracy.

The American Beverage Corp. this week filed a U.S. federal trademark suit against Diageo North America, parent company of Captain Morgan Rum, over their new Parrot Bay Tropical Frozen Drink Pouches.

Since 2005, AmBev of suburban Pittsburgh has been making and marketing Daily’s Cocktails, single-serving pouches of frozen margaritas, daiquiris and pina coladas.

Pouch Pac Innovations, which invented the drink pouches, is also involved in the lawsuit filed in Pennsylvania West District Court on Monday.

Diageo, which bases its North American operation in Toronto, said it “will vigorously defend its rights against any allegations of infringement.

“Diageo is confident it will prevail in this matter.”

None of these products are, or will be, available in Ontario.
